2. Acceptance of Terms
By accessing or using our website, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use our website or engage our services. You must be at least 18 years of age to use this website or enter into a service agreement with us. By engaging our services, you represent that you have the legal capacity to enter into a binding agreement.
3. Description of Services
indigo pa provides legal services in three practice areas: tax dispute and appeal support, guardianship applications, and e-commerce legal compliance. The specific scope of each engagement is defined in the engagement letter issued at the commencement of each matter. Our services are available to individuals and businesses within Malaysia.
4. User Responsibilities
When using our website, you agree to provide accurate information in all forms and communications, to use the website only for lawful purposes, and not to attempt to gain unauthorised access to any part of the website or its systems. You are responsible for maintaining the confidentiality of any account information and for all activities conducted under your access.
5. Intellectual Property
All content on this website, including text, graphics, logos, and design elements, is the property of indigo pa or its licensors and is protected under Malaysian intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this website without our prior written consent. You are granted a limited, non-transferable licence to access and view the content for personal, non-commercial use only.
6. Payment Terms
Our services are offered at fixed fees as published on our website and confirmed in the engagement letter. Fees are quoted in Malaysian Ringgit (MYR). Payment terms, including deposit requirements and payment schedule, are specified in the engagement letter. We accept payment via bank transfer and online banking. If the scope of your matter changes materially during the engagement, any fee adjustment will be discussed and agreed in writing before additional work is undertaken.
7. Service-Specific Terms
Tax Dispute and Appeal Support: This service covers the scope outlined in the engagement letter. Representation is provided before the Special Commissioners of Income Tax. Any further appeals to the High Court or beyond fall outside the standard engagement and require a separate agreement.
Guardianship Application: This service covers preparation and filing of the court application, supporting documentation, and attendance at the guardianship hearing. Post-order applications or variations require a separate engagement.
E-Commerce Legal Compliance Package: This service includes the review and drafting of specified legal documents and a compliance checklist. The package does not include ongoing legal retainer services or representation in any dispute arising from the documents.
8. Disclaimers
The information on this website is provided for general informational purposes and does not constitute legal advice. No solicitor-client relationship is formed by your use of this website or by submitting a contact form enquiry.
While we strive to provide high-quality legal services, we do not make representations about specific outcomes. The resolution of legal matters depends on many factors, including the merits of the case, the conduct of opposing parties, and decisions of the relevant tribunal or court.
9. Limitation of Liability
To the fullest extent permitted by Malaysian law, indigo pa shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with your use of our website or services. Our total liability in connection with any engagement shall not exceed the fees paid by you for that specific engagement. Nothing in these terms excludes liability for fraud, wilful misconduct, or any liability that cannot be excluded under Malaysian law.
10. Indemnification
You agree to indemnify and hold harmless indigo pa, its partners, associates, and employees from any claims, damages, losses, or expenses (including legal fees) arising from your breach of these Terms and Conditions, your misuse of our website, or any inaccurate information you provide to us during an engagement.
11. Termination
Either party may terminate an engagement by providing written notice to the other party. Upon termination, you are responsible for payment of fees for work already performed. We will provide you with copies of all documents prepared on your behalf. We reserve the right to withdraw from an engagement in accordance with the rules of the Malaysian Bar if circumstances require.
12. Dispute Resolution
These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising from or in connection with these terms shall first be attempted to be resolved through informal negotiation. If informal resolution is not possible, the dispute shall be submitted to the jurisdiction of the courts of Malaysia, specifically the courts of Kuala Lumpur.
13. General Provisions
These Terms and Conditions constitute the entire agreement between you and indigo pa regarding the use of our website. If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of that right. We may not assign our rights under these terms without your consent, except in connection with a merger or acquisition.
14. Changes to These Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on this page with an updated revision date. Your continued use of the website after any changes constitutes acceptance of the revised terms. We recommend reviewing these terms periodically.
